Partner Craig Rizzo successfully absolved of liability a municipal client sued by two infant plaintiffs involved in an intersection collision with co-defendants. Multiple other defendants were named, including the car seat manufacturer. The infant plaintiffs alleged that our municipal client was responsible for regulating speed and traffic conditions on the roadway, which alleged negligence resulted in an intersection collision that allegedly left one of the infants a quadriplegic and required a cervical fusion surgery, among other significant injuries and treatment modalities required. The other infant plaintiff allegedly sustained severe pelvic fractures and other orthopedic injuries as well. After multiple depositions and extensive discovery requiring tremendous preparation, Craig and his team preemptively defeated plaintiffs’ and co-defendants’ claims against the municipality on all issues of liability such that he secured a Stipulation of Discontinuance with prejudice terminating all claims against the client.
